Preventative Healthcare Solutions provides healthcare support, care coordination, administrative services, technology-enabled healthcare services, and related clinical support in collaboration with affiliated licensed healthcare professionals and participating pharmacies.
Healthcare services may include, but are not limited to:
- Chronic Care Management (CCM)
- Remote Patient Monitoring (RPM)
- Remote Therapeutic Monitoring (RTM)
- Telehealth services
- Medication adherence programs
- Care coordination
- Clinical follow-up services
- Preventive care support
- Pharmacy collaboration
Clinical services are provided by appropriately licensed physicians, nurse practitioners, pharmacists, or other licensed healthcare professionals acting within the scope of applicable federal and state law.
Availability of healthcare services may vary based upon:
- State licensing requirements
- Provider availability
- Insurance participation
- Medicare eligibility
- Commercial payer participation
- Applicable law
Pharmacy Collaboration
Certain Services are provided in collaboration with participating pharmacies.
Participating pharmacies may assist with:
- Patient identification
- Scheduling appointments
- Medication reconciliation
- Medication adherence support
- Care coordination
- Device distribution
- Remote monitoring support
- Administrative services
Clinical decisions, diagnoses, treatment recommendations, prescribing decisions, and medical judgment remain solely the responsibility of licensed healthcare professionals.

Medical Emergencies
THE SERVICES ARE NOT DESIGNED FOR EMERGENCY MEDICAL CARE.
DO NOT USE THE SERVICES TO REPORT A MEDICAL EMERGENCY.
IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY OR GO TO THE NEAREST EMERGENCY DEPARTMENT.
DO NOT RELY ON EMAIL, TEXT MESSAGE, WEBSITE FORMS, OR OTHER ELECTRONIC COMMUNICATIONS FOR URGENT MEDICAL NEEDS.
Insurance Coverage
Eligibility for healthcare services, insurance coverage, reimbursement, copayments, deductibles, coinsurance, and other patient financial responsibilities are determined by your health plan and applicable law.
Participation in the Services does not guarantee:
- Insurance coverage;
- Medicare reimbursement;
- Commercial payer reimbursement;
- Payment for healthcare services; or
- Coverage for any specific healthcare service.
Patients remain responsible for any applicable copayments, deductibles, coinsurance, or non-covered services as required by their health plan or applicable law.
Changes to these Terms
We reserve the right to revise or update these Terms at any time.
Updated Terms become effective immediately upon posting to the Website unless otherwise stated.

By providing your mobile telephone number to Preventative Healthcare Solutions, one of our affiliated licensed healthcare professionals, a participating pharmacy, or another authorized representative, you consent to receive text messages, push notifications, or similar electronic communications related to your healthcare and your use of the Services.
These communications may include:
- Appointment confirmations
- Appointment reminders
- Care coordination
- Medication reminders
- Device onboarding
- Remote monitoring support
- Care management communications
- Billing notifications
- Patient satisfaction surveys
- Other healthcare-related communications
Where permitted by law, messages may also include information regarding services that may be relevant to your healthcare.
Consent to receive text messages is not required as a condition of receiving healthcare services.
However, opting out of text messaging may limit our ability to communicate efficiently regarding your care.

You are solely responsible for all such charges.
Mobile Carriers
Delivery of text messages depends upon third-party wireless carriers.
Preventative Healthcare Solutions does not guarantee:
- Delivery;
- Timing;
- Availability;
- Accuracy; or
- Successful transmission
of any text message.
Wireless carriers are not responsible for delayed or undelivered messages.
Telephone Number Changes
You agree to notify us promptly if your mobile telephone number changes.
You agree to indemnify Preventative Healthcare Solutions and its affiliates against claims arising from your failure to update your contact information.
Suspension or Termination of Messaging
We may suspend or discontinue text messaging services at any time without prior notice.
Participation automatically terminates if your wireless service is cancelled or otherwise becomes unavailable.
Healthcare Professionals
Healthcare services offered through Preventative Healthcare Solutions are provided by affiliated licensed physicians, nurse practitioners, pharmacists, and other appropriately credentialed healthcare professionals.
Provider availability varies based upon:
- State licensure;
- Scope of practice;
- Insurance participation;
- Scheduling availability;
- Applicable law; and
- Clinical appropriateness.
Nothing contained within the Services guarantees that a particular provider will be available or appropriate for your healthcare needs.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREVENTATIVE HEALTHCARE SOLUTIONS DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT;
- TITLE;

- UNINTERRUPTED OPERATION.
WE DO NOT WARRANT THAT:

- ERRORS WILL BE CORRECTED;
- THE SERVICES WILL BE SECURE;
- THE SERVICES WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS; OR

YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICES.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREVENTATIVE HEALTHCARE SOLUTIONS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PROVIDERS, PHARMACY PARTNERS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR LOST PROFITS DAMAGES ARISING FROM OR RELATING TO:
- YOUR USE OF THE SERVICES;
- YOUR INABILITY TO USE THE SERVICES;
- DELAYS OR INTERRUPTIONS;
- ERRORS OR OMISSIONS;
- THIRD-PARTY SERVICES;
- TEXT MESSAGE DELIVERY FAILURES;
- INTERNET FAILURES;
- DATA LOSS; OR
- SECURITY BREACHES NOT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:
- ONE HUNDRED U.S. DOLLARS ($100); OR
- THE AMOUNT PAID BY YOU DIRECTLY TO PREVENTATIVE HEALTHCARE SOLUTIONS DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

If you submit suggestions, ideas, comments, recommendations, or other feedback (“Feedback”), you acknowledge and agree that:

Limitation on Actions
To the maximum extent permitted by law, any claim or cause of action arising out of or relating to these Terms or the Services must be commenced within one (1) year after the claim arises.

Dispute Resolution

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles.
Subject to the arbitration provisions above, any judicial proceeding permitted under these Terms shall be brought exclusively in the state or federal courts located in South Carolina, and the parties consent to the personal jurisdiction of those courts.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
